These Terms and Conditions govern all bookings, participation, and services provided by 8000 Club ("Company", "We", "Us", "Our"). By submitting a booking, deposit, or participating in any expedition organized by 8000 Club, the participant ("Client", "Climber", "You") acknowledges that they have read, understood, and agreed to these Terms and Conditions.

1. Nature of Expeditions

1.1. 8000 Club organizes and facilitates mountaineering expeditions to peaks exceeding 8,000 meters in elevation.

1.2. High-altitude mountaineering involves significant risks, including but not limited to: severe weather conditions, avalanches, rockfall and icefall, altitude sickness, frostbite and hypothermia, injury, illness, disability or death, transportation delays and cancellations, and natural disasters or other unforeseen events.

1.3. Participation is entirely voluntary, and each Client accepts these risks knowingly and willingly.

2. Eligibility and Fitness Requirements

2.1. Clients must be at least 18 years of age unless otherwise approved in writing by the Company.

2.2. Clients must possess adequate physical fitness, technical climbing skills, and high-altitude experience suitable for the chosen expedition.

2.3. The Company reserves the right to reject or remove any participant whose physical condition, behavior, or experience is deemed unsuitable for the expedition.

2.4. Clients are responsible for obtaining medical clearance prior to joining the expedition.

3. Booking and Payment

3.1. A booking is confirmed only after receipt of the required deposit and written confirmation from the Company.

3.2. The remaining balance must be paid according to the payment schedule specified in the expedition agreement or invoice.

3.3. Failure to complete payments by the due dates may result in cancellation of the booking without refund of amounts already paid.

3.4. All bank charges, transfer fees, currency conversion fees, and related expenses are the responsibility of the Client.

4. Expedition Fees

4.1. Expedition fees generally include only those services specifically listed in the expedition package.

4.2. Unless expressly stated otherwise, expedition fees may exclude: international airfare, visa costs, personal climbing equipment, personal insurance, emergency evacuation expenses, personal communication charges, bar bills and personal expenses, additional accommodation outside the itinerary, and costs arising from early departure or expedition extension.

4.3. Any services requested outside the agreed package shall be charged separately.

5. Cancellation by Client

5.1. All cancellation requests must be submitted in writing.

5.2. Deposits are generally non-refundable unless otherwise stated in the expedition agreement.

5.3. Refund eligibility depends on the timing of cancellation and the expenses already incurred by the Company, including permits, logistics, staff commitments, transportation, and government fees.

5.4. Government permit fees, liaison fees, environmental fees, and other non-refundable expenses shall not be refunded under any circumstances once processed.

6. Cancellation or Modification by the Company

6.1. The Company reserves the right to modify, postpone, shorten, reroute, or cancel any expedition due to weather conditions, government restrictions, political instability, natural disasters, health emergencies, safety concerns, insufficient participation, or any event beyond the Company's reasonable control.

6.2. The Company shall not be liable for additional expenses incurred by the Client due to such modifications or cancellations.

6.3. Where possible, the Company may offer alternative arrangements, credits, or rescheduling options at its sole discretion.

7. Assumption of Risk

7.1. The Client acknowledges that high-altitude mountaineering is inherently dangerous.

7.2. The Client voluntarily assumes all risks associated with participation, including risks that may result from the acts, omissions, negligence, equipment failure, environmental hazards, or decisions made during the expedition.

7.3. Summit success is not guaranteed.

7.4. No refund shall be provided due to failure to reach a summit.

8. Guides, Sherpas, and Expedition Leadership

8.1. Expedition leaders, guides, and Sherpas retain authority regarding safety decisions.

8.2. All Clients must follow instructions issued by expedition leadership.

8.3. The Company reserves the right to require a Client to descend, discontinue climbing, or withdraw from the expedition if deemed necessary for safety reasons.

8.4. Such decisions are final and are not grounds for refund or compensation.

9. Medical Treatment and Evacuation

9.1. Clients are responsible for maintaining their own health and monitoring their physical condition.

9.2. In the event of illness or injury, expedition staff may arrange emergency assistance when reasonably possible.

9.3. Any rescue, helicopter evacuation, medical treatment, hospitalization, repatriation, or related expenses shall be borne solely by the Client.

9.4. The Company makes no guarantee regarding rescue availability or response times in remote mountain environments.

10. Insurance Requirements

10.1. Comprehensive travel and mountaineering insurance is mandatory.

10.2. Insurance must include: high-altitude mountaineering coverage, emergency medical treatment, helicopter rescue and evacuation, search and rescue expenses, repatriation, and trip cancellation and interruption coverage.

10.3. Proof of valid insurance may be requested before expedition commencement.

10.4. Failure to provide adequate insurance may result in denial of participation without refund.

11. Equipment Responsibility

11.1. Clients are responsible for bringing and maintaining suitable personal climbing equipment.

11.2. The Company shall not be responsible for loss, theft, damage, or malfunction of personal equipment.

11.3. Expedition leaders may prohibit the use of equipment considered unsafe or inadequate.

12. Environmental Responsibility

12.1. Clients agree to comply with local environmental regulations and Leave No Trace principles.

12.2. Clients shall respect local communities, cultures, traditions, and protected environments.

12.3. Any fines, penalties, or liabilities resulting from a Client's actions shall be borne solely by the Client.

13. Conduct and Behavior

13.1. Clients must behave respectfully toward fellow climbers, guides, staff, local communities, and authorities.

13.2. Harassment, violence, discrimination, illegal activities, reckless conduct, or behavior endangering others may result in immediate removal from the expedition.

13.3. No refund shall be provided in such circumstances.

14. Photography and Media

14.1. The Company may photograph or record expedition activities for promotional, educational, and marketing purposes.

14.2. By participating, Clients grant the Company permission to use photographs, videos, and recordings in which they may appear, unless otherwise requested in writing before the expedition.

15. Limitation of Liability

15.1. To the fullest extent permitted by law, 8000 Club, its owners, employees, guides, Sherpas, contractors, partners, and affiliates shall not be liable for personal injury, illness, death, property loss or damage, financial loss, travel disruptions, delays, or consequential or indirect damages.

15.2. The Company's liability, if any, shall be limited to the amount actually paid by the Client for the expedition.

16. Force Majeure

16.1. The Company shall not be liable for failure to perform obligations resulting from events beyond its reasonable control, including natural disasters, earthquakes, avalanches, floods, epidemics or pandemics, war, civil unrest, government actions, transportation disruptions, or extreme weather.

17. Governing Law and Jurisdiction

17.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Nepal.

17.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.

18. Acceptance

By making a booking, paying a deposit, signing a registration form, or participating in any expedition organized by 8000 Club, the Client confirms that they have read and understood these Terms and Conditions, understand the risks associated with high-altitude mountaineering, voluntarily accept such risks, agree to comply with expedition leadership decisions, and release and hold harmless 8000 Club to the fullest extent permitted by law.
