8000 Club ("Company", "We", "Us", "Our") provides mountaineering expeditions, trekking services, and related travel arrangements. These Terms and Conditions govern your use of our website and your participation in any expedition, trek, or service offered by the Company.

By booking a service, using our website, or otherwise engaging with 8000 Club, you agree to be bound by these Terms and Conditions.

1. Booking and Confirmation

1.1. All bookings are subject to availability and confirmation by the Company.

1.2. A booking is considered confirmed only upon receipt of the required deposit or full payment, as specified at the time of booking.

1.3. Clients must provide accurate personal, medical, and travel information at the time of booking.

1.4. The Company reserves the right to decline or cancel any booking at its sole discretion.

2. Payments

2.1. Payment schedules, deposit amounts, and balance due dates will be communicated at the time of booking.

2.2. All payments must be made in the currency and through the payment methods specified by the Company.

2.3. Failure to complete payment by the agreed deadline may result in cancellation of the booking without refund of any deposit already paid.

2.4. Prices are subject to change without prior notice due to factors including but not limited to permit fees, transportation costs, and government regulations, except where a booking has already been confirmed in writing.

3. Cancellations and Refunds

3.1. Cancellations must be submitted in writing to the Company.

3.2. Refund eligibility, if any, will depend on the timing of cancellation relative to the expedition start date and any non-refundable costs already incurred (permits, logistics, accommodation deposits).

3.3. The Company is not responsible for refunding costs related to international flights, visas, or personal travel insurance.

3.4. No refunds shall be issued for early termination of an expedition due to a client's voluntary withdrawal, illness, injury, or failure to meet fitness or medical requirements.

4. Expedition Risks and Acknowledgment

4.1. Clients acknowledge that high-altitude mountaineering and trekking involve inherent and significant risks, including but not limited to altitude sickness, extreme weather, avalanches, crevasses, equipment failure, and risk of serious injury or death.

4.2. Clients participate in all expeditions and treks at their own risk.

4.3. The Company, its guides, staff, and partners shall not be held liable for any injury, illness, death, loss, or damage arising from participation in our services, except where caused by proven gross negligence on the part of the Company.

4.4. Clients are strongly advised to obtain comprehensive travel and high-altitude rescue insurance prior to participation.

5. Medical and Fitness Requirements

5.1. Clients must disclose all relevant medical conditions prior to booking.

5.2. The Company reserves the right to request medical clearance or proof of fitness before confirming participation in any expedition.

5.3. Failure to disclose a relevant medical condition may result in removal from the expedition without refund.

5.4. The Company reserves the right to remove any client from an expedition at any stage, without refund, if their continued participation is deemed a safety risk to themselves or others.

6. Permits and Documentation

6.1. Clients are responsible for ensuring they hold valid passports, visas, and any other travel documentation required for their trip.

6.2. The Company will assist with obtaining necessary climbing and trekking permits but is not liable for delays or denials caused by government authorities.

7. Itinerary Changes

7.1. Itineraries are subject to change due to weather conditions, political situations, route conditions, government regulations, or other circumstances beyond the Company's control.

7.2. The Company will make reasonable efforts to notify clients of any changes and provide suitable alternatives where possible.

7.3. No compensation shall be due for itinerary changes resulting from circumstances beyond the Company's control.

8. Force Majeure

8.1. The Company shall not be held liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, political unrest, pandemics, government action, or transportation disruptions.

9. Client Conduct

9.1. Clients are expected to follow the instructions of guides and expedition staff at all times for safety purposes.

9.2. The Company reserves the right to remove any client from an expedition, without refund, for conduct that endangers themselves, other team members, staff, or local communities.

10. Use of Website

10.1. Content on this website, including text, images, logos, and graphics, is the property of 8000 Club and may not be reproduced without prior written consent.

10.2. The Company makes reasonable efforts to ensure website information is accurate but does not guarantee completeness or that the website will be error-free or uninterrupted.

11. Limitation of Liability

11.1. To the fullest extent permitted by law, the Company's total liability for any claim arising from its services shall not exceed the amount paid by the client for the relevant service.

11.2. The Company is not liable for indirect, incidental, or consequential damages arising from the use of its services.

12. Indemnification

12.1. Clients agree to indemnify and hold harmless 8000 Club, its staff, guides, and partners from any claims, damages, or expenses arising from the client's participation in expeditions or use of services, except where caused by proven gross negligence of the Company.

13. Governing Law

13.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal.

13.2. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

14. Changes to These Terms

14.1. The Company reserves the right to update or modify these Terms and Conditions at any time.

14.2. Updated versions shall become effective upon publication on our website unless otherwise stated.

14.3. Continued use of our services after publication constitutes acceptance of the revised Terms and Conditions.
